Terms and Conditions

By using the products and services of Travel Mode LLC doing business as Travel Mode, the traveler has read, understands, accepts and agrees to the Terms and Conditions and to be bound by the Terms and Conditions.

Reservations: Travel Mode can be reached by phone at (404) 404-8720, our email at travelmode@travelmodellc.com, or the “Contact” feature on Travel Mode’s website. For Travel Mode Group Trips, click on the “Reserve Now” button for each group trip listed on the “Travel Mode Travel Group” menu at www.travelmodellc.com.

Travel Name(s), Passports, and Visas: Reservations must be made in the full name that is listed on traveler’s passport. Name changes after travel documents have been issued could result in change fees.

The traveler is responsible for having proper travel documents and must check with the passport or visa agency to determine visas or passports requirements. Passports are required to be valid for at least 6 months after the date of travel. Travel Mode does not provide or validate travel requirements for non-US citizens. A passport is suggested for cruises.

Payments: Reservations can be made online with major credit cards only.

Deposit: A deposit is due at the time of the reservation whether an individual reservation (Travel Mode) or a group trip through Travel Mode Travel Group. All deposits are non-refundable and non-transferable.

Travel Mode Group Trip Prices: All prices listed for group trips through Travel Mode Travel Group are per person unless specified otherwise. Prices do not include items of a personal nature, such as laundry, wines, water, beverages, food (other than at all-inclusive resorts or where clearly specified), passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions.

Late Payment: If there is any outstanding balance by the Final Payment Due date listed on your invoice, a late fee of $50 will automatically be added to your invoice one day after your final payment date.

Trip Refunds: All payments to Travel Mode are non-refundable and non-transferable due to Travel Mode’s contractual agreements with hotels, airlines, and other vendors that will not allow for refunds.

Trip Chargebacks: Please contact Travel Mode through either one of the channels listed in the “Reservations” section of the Terms and Condition. Filing chargebacks could result in trip cancellation and prevent future travel planning, arrangements, trips, reservations, etc. through Travel Mode including with Travel Mode Travel Group.

Travel Insurance: Travel insurance is recommended for all trips in case a traveler needs to cancel the trip. Travel insurance is non-refundable once purchased and covers all air when packaged with the hotel. Travel insurance must be paid in full and will be collected at the time of initial deposit.

Trip Cancellation: Once reservations have been made, cancellations will only be accepted in writing. Send cancellation requests to travelmode@travelmodellc.com with your full name, travel date, and any other identifying information related to the trip reservation. Travel Mode will email you a Trip Cancellation Form for the traveler to complete and return. Upon receipt of the form, Travel Mode will process the cancellation.

Assumption of Liability of Risk: By participating in Travel Mode group trips, the traveler accepts that he/she may undertake hazardous activities and excursions, with a risk of illness, injury, or death which may be caused by forces of nature, insects, animals, food, drinks, flora, or just via participation on the trip and does not hold Travel Mode responsible in the event that one or more of those outcomes occur.  Medical services or facilities may not be readily available or accessible during some or all the trip. The traveler accepts and assume full responsibility for all risks of illness, injury, or death and agree to hold harmless and release Travel Mode from claims of third-party negligence.

The traveler understands the physical requirements of the trip activities and excursions. The traveler has no known physical, medical, or mental condition which could impair the traveler’s ability to participate in this trip.  The traveler is willing to assume all risks that may be created, directly or indirectly, by any events that may occur during the trip.

Force Majeure: There may be times when either party is unable to perform, or complete performance, under the travel contract for reasons out of each other’s control. Events that may trigger this include but are not limited to, acts of God, acts of government, acts of war or civil unrest, insurrection or revolts, military action, strikes or other labor activities, criminal or terrorist activities of any kind, or the threat thereof, pandemics, epidemics, illnesses or health conditions prevalent in the area of travel, earthquakes, hurricanes, lightning, and explosions, unexpected legislation, or any other event outside the reasonable control of either party. If a force majeure event occurs, the parties will look to and follow the cancellation policies of the suppliers, what is stated in the travel proposal, and these terms & conditions. Any changes to those policies are at the sole discretion of the supplier (if applicable) and Travel Agency. Travelers will be informed of their options if a force majeure event occurs.

Photo Release: Travel Mode may take photographs or video of its trips, and travelers grant Travel Mode permission to do so for promotional or commercial use without payment of any compensation to the participant.

Liability Disclaimer: The information, products, and services published on this website may include inaccuracies or typographical errors. Binding Arbitration: The traveler and Travel Mode agrees that any disputes shall be resolved exclusively by binding arbitration. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of the Terms and Conditions and Traveler Agreement.  Please understand that by agreeing to these terms and conditions, you (and we) are waiving our right to a trial by jury.

Traveler Agreement: All travelers must complete a Traveler Agreement before travel and, by so doing, formally accepts Travel Mode’s Terms & Conditions. Travelers booking online will be required to complete the Traveler Agreement at the time of booking. Travel documents will not be released without a completed Traveler Agreement. Travel Mode LLC the right to cancel bookings and return deposits without a completed Traveler Agreement. The Traveler Agreement incorporates these Terms & Conditions, including the following Assumption of Liability and Risk, and Binding Arbitration Clauses.

Indemnification: The traveler agrees to indemnify, defend and hold harmless Travel Mode LLC dba Travel Mode, its affiliates, officers, directors, employees, agents, information providers, partners, advertisers, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorney’s fees, resulting from (a) provision of Unsolicited Information by You, or (b) Your use of the Content or Website; and/or (c) Your breach of these Terms, (including without limitation infringement of third parties’ worldwide intellectual property rights, negligent or wrongful conduct, claims or liability for violation of personal or property rights, right of portrait, defamation, libel, false light, invasion of privacy, public disclosure of private facts, emotional distress or misappropriation) by You or any other person accessing the Website using your Account.
